New Changes to the Law:
In July 2010, a new approach to calculating child support was signed into law. The law drastically changes the way in which child support is calculated and adds even more hurdles to an already difficult process. If you or a loved one is going through a divorce or contesting a child support or timesharing arrangement, it is easy to feel overwhelmed. However, it is helpful to have an experienced attorney guiding you through the process and explaining it in simple terms.
It used to be that unless you had your child (children) for 40% of the overnights, you did not receive any type of substantial credit toward child support. Now, any parent who has their child (children) for at least 20% of the overnights (i.e. every other weekend from Friday to Monday, alternating holidays and 1/2 the summer) will get a substantial credit towards child support.
Additionally, there have been significant changes made to the requirements in child support orders, income deduction orders, and the daycare expense credit. As of this year, all child support orders and income deduction orders must have a specific termination date that child support ends, and have a step down child support amount specified if there is more than one child. This means that in every order, there will have to be a termination date after the first child reaches the age of majority, and then a changed amount and a termination date for each child thereafter. Furthermore, the daycare expense credit of 25% has been eliminated. As of this year, you will now get credit for 100% of your daycare costs.
